The Court rules that a federal rule barring recipients of federal family planning funds from providing counseling about or referrals for abortions ("the gag rule") does not violate either freedom of speech or the right to privacy. Newly appointed Justice Souter provided the crucial fifth vote to uphold the gag rule.

Justice Thurgood Marshall (pro-choice) retires and is replaced by Justice Clarence Thomas (anti-choice).
