The Supreme Court's declaration in Roe v. Wade -- that the right to choose abortion is protected by the Constitution -- has been eroded over time as Justices hostile to Roe have joined the Court. Whereas Roe limited state regulation of abortion, later cases expanded the ability of states to control it by using ever-weaker criteria, or standards of review, to evaluate the impact of the state laws on abortion rights.
